The user agrees and acknowledges that FORCE TRACK can fetch the helper or employee proprietorship/partnership firm/company/organization/director’s PAN number through the APIs which are added by the user on the FORCE TRACK portal at the time of employee or helper verification.

We may obtain information about you from other sources, including if you connect or link a profile or wallet from a third party, we may obtain certain information that identifies you. We may also obtain data from publicly-available sources and/or data suppliers from which we obtain data to validate or supplement the information we hold. Links to third-party websites, plug-ins, and applications may be found on this website. It’s possible for third parties to gather or share information about you if you click on those links or enable those connections. Such external websites are not covered by this privacy statement. We may use personal information shared by you or the Consumer during the process of registration or otherwise for verification purposes and it is deemed that the consumer agrees and allows FORCE TRACK to share such information with third parties solely for verification purposes. We may also use the information you provide to update our consumer credit database.

We may provide information collected from you to government authorities or any court of law as per the applicable laws of India or as per our agreement with our third-party service providers or any third party. However, such third parties receiving your personal information shall not disclose it further, save and except if required under any law.

3.2) Vault Verification

The data identified above is processed to provide our Vault Verification service, a form of identity check whereby we:

  • Analyze your government-issued identification against an image capture of your face (a “selfie”) using our facial recognition technology;
  • Initiate a background check to which you must consent; collect a video attestation from you; Review a self-recorded, video attestation and confirm the identification made via automated processing (no identity verification is completed without human review by Force Track);
  • and issue a blockchain id certifying your Force Track vault verification; Biometric data is stored only so long as is needed;
  • Certain data (e.g., your image and certain identification materials) will be securely stored by Force Track for the duration of your verification (Force Track vault verification expires after one year).

Your blockchain certificate is a unique, personal identifier. Your information will be stored in an immutable chain as part of a database called a distributed ledger, and may not later be changed or deleted.

3.3) Connection to third-party website

We may provide links to third-party websites. These third-party websites may collect personal information about you on their websites, and our Privacy Policy does not apply to these third-party websites or external websites. 5.1) Severability

In the event that any provision of these Terms is declared by any judicial or other competent authority to be void, voidable, illegal, or otherwise unenforceable or indications of the same are received by either me/us or FORCE TRACK from any relevant competent authority, FORCE TRACK shall have the right to amend that provision in a such reasonable manner as it thinks fit without illegality or it may be severed from this Agreement in such manner as FORCE TRACK thinks fit and the remaining provisions of these Terms shall remain in full force and effect unless FORCE TRACK decides in its sole discretion to stop the provision of the Report/s and/or Products and Services either wholly or in part.

5.2) MINORS

User agrees that who are underage are not meant to use the platform or its contents (those under 18 years of age). We are unable to determine the age of I/We accessing our Platform, nevertheless. We will remove the account and all associated data as soon as we become aware that a person providing User Information is under the legal age limit. Children under the age of 18 are not intended for use on our website or our services, and we do not intentionally collect personal information from them. Other than as otherwise provided by these Terms, all alterations to these Terms shall be made by FORCE TRACK with an intimation on its Website and the term shall become applicable imminently upon such intimation on the website, and FORCE TRACK does not hold any requirement of any prior notice or intimation to any Consumer of such variation. User agree to accept any such variation made by FORCE TRACK in this regard regardless of the mode through which the user has approached FORCE TRACK.

5.4) Indemnification

User acknowledge that this Platform hold the Company/Platform, and their respective directors, officers, employees, and agents (collectively, “Parties”), harmless from and against any losses, liabilities, claims, damages, demands, costs, and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by you that arise out of, are caused by, or may be payable by any breach or non-compliance with any of the terms and conditions of this Agreement.

User acknowledge that no matter how unlikely they may be, whether or not the Company/Platform was informed of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other cause of action, the Company shall under no circumstances be obligated to pay the user or any third party for any special, incidental, indirect, consequential, or punitive damages whatsoever, including those resulting from loss of use, data, or profits.

4.5) Transfer of rights

User shall not assign or transfer any of my rights and/or obligations in relation to the transaction contemplated herein under or pursuant to these Terms to any other person.

5.6) Governing Law, Jurisdiction, and Arbitration

The Parties hereto explicitly agree that any disputes relating to the creation, interpretation, and execution of these Terms, as well as any other problems related thereto, shall be handled by arbitration. The Parties additionally concur that the provisions of this Section shall remain in effect even after the expiration or termination of the Terms and/or Policy.

Arbitration: If a disagreement between the Parties cannot be settled amicably through mediation, the Company shall select a sole arbitrator appointed by FORCE TRACK to hear the matter, and the arbitrator’s decision will be valid and binding on both parties. The expenses of the proceedings shall be borne by the Parties, although the sole arbitrator may, in his or her sole discretion, order either Party to cover the whole cost of the proceedings. The arbitration shall be conducted in English and shall be subject to the exclusive jurisdiction of the Courts in Jaipur, Rajasthan.

The parties explicitly concur that the laws, regulations, and rules of the country in which the parties are located will control the terms, policies, and any other agreements they sign into.

5.7) Miscellaneous

By signing this document, user grant FORCE TRACK the right to use any data and information that user supply via the Request Forms in any way, including for any purpose specified by FORCE TRACK, so long as doing so complies with all relevant laws.

By submitting user cellphone number and email address, user acknowledge and agree to get SMS/Email updates on the progress of my/our purchase for Reports/Products/Services placed on FORCE TRACK’s website(s) (FORCE TRACK). User also understand that by submitting the aforementioned cell number and email address(es), have further consented to receive calls and emails from FORCE TRACK, their agents, etc. regarding any other FORCE TRACK services not specifically mentioned in this document.

The validity, legality, and enforceability of the remaining provisions and clauses of these Terms shall not be affected or impaired in any way by the invalidity, illegality, or unenforceability of any provision or clause of these Terms, and each such provision or clause of these Terms shall be valid and enforceable to the fullest extent permitted by law. 5.8) Force Majeure

User agrees and acknowledge that if a delay or failure to perform an obligation under this agreement is caused by an event outside of the Company’s or Platform’s control, without their fault or negligence, such as a war, an act of God, an earthquake, a pandemic, a riot, a fire, sabotage of holiday activities, a labor shortage or dispute, an internet outage, a technical issue, a break in a sea cable, hacking, or piracy, neither the Company nor the Platform. If the performance is stopped, hampered, or delayed by a Force Majeure Event, FORCE TRACK shall not be responsible for any failure to fulfill any of its duties under these Terms or to supply the Report(s), Goods, and Services, or any portion thereof (defined below) and in such case its obligations shall be suspended for so long as the Force Majeure Event continues.
