Welcome to our FORCE TRACK platform, accessible via our website and mobile application (“Platform”). Before you start using our Platform, we kindly ask you to review and understand the following Terms and Conditions (“Terms”) that govern your access and use of our Platform. You agree to be bound by these Terms by accessing or using our Platform. If you do not agree to these Terms, please do not use our Platform.

Our goal is to create a more trustworthy, open, and safe online environment. You may use and access our services, software, and websites (“Services”) subject to the terms and conditions set out in this document (“Terms”). The way we gather and use your information as described in our Privacy Policy, and your obligations when using our Services are described in our Acceptable Use Policy. You accept these Terms and our Privacy Policy and Acceptable Usage Policy by using our Services.

The words, “I”, “We”, “us”, “me”, “my”, “myself”, M/s “customer” and “consumer” refer to the Person(s) who request their respective Reports or receive the Products and Services or pursue the Transaction (as defined hereinabove) or part thereof (Consumer) and shall include both singular and plural. Reference to the masculine gender shall include the feminine and neutral gender or any other legal entity.

Generals Terms

  1. I/We agree and understand that the headers of each part in these Terms or the Privacy Policy serve solely to categorize the various provisions under these Terms and the Privacy Policy, and either Party may use them to interpret the provisions hereof in a way that may be applicable to the Users. I/We agree and acknowledges that the headings will have legal or contractual value for I/We using the Platform’s services.
  2. I/We agree and understand that these Terms, the Privacy Policy, and any other policies that may be published on the force track platform for the purpose of the Users’ effective application, as well as any modifications or additions made thereto from time to time by the Company, at its sole discretion, govern how the I/We use this platform.
  3. I/We agree and understand that these Terms and the aforementioned Policies represent a binding contract between me/us and the Company that must adhere to all rules, policies, terms, and conditions set forth by the Indian Government with regard to any service made available through the Platform. These rules, guidelines, policies, and terms and conditions shall be deemed to be incorporated into these Terms and shall be treated as an integral part of them.
  4. I/We agree and understand that neither a written agreement nor an express act is necessary for these Terms and the Policy to bind, and that simply accessing any section of the Platform entails me/us full and unconditional acceptance of these Terms and the aforementioned Policy.
  5. I/We agree and understand that any such amendments or modifications shall take effect straight away. The Company has the sole and exclusive right to amend or modify these Terms without me/us consent or prior notification.

Permissions

You acknowledge and agree that when you submit, upload, transmit, or otherwise make available to us any data, information, media, or other content in connection with your use of our Services (” Your Information”), you will continue to be the owner of and accountable for your information and you are granting FORCE TRACK, the Services, and any upcoming new services that we may offer, a permanent, non-exclusive, transferable, sub-licensable, global license to use your information. If your thing contains personal information, all such uses shall adhere to our privacy policy. We and our affiliated companies are granted the right to: copy, reproduce, host, store, process, adapt, modify, translate, perform, distribute, and publish your information throughout the globe in all media and by all distribution techniques, including those that are developed in the future; In accordance with these Terms and the features of, you hereby grant other FORCE TRACK I/We a non-exclusive permission to access and utilize Your Information inside FORCE TRACK; In compliance with the Privacy Policy, we may share Your Information with third parties that help us provide, market, develop, and improve FORCE TRACK.

You agree to abide by these Terms, including our Acceptable Use Policy, when submitting your information and using the services, and we may use the name you provide in connection with your information (whether it be your account name, real name, or another name).

Additionally, you acknowledge and agree that pursuant to these Terms, our Privacy Policy, and any relevant laws or regulations, we and our affiliated entities may:

  • You may keep and use Your Information even after you stop using FORCE TRACK;
  • You may be required to keep or disclose Your Information in order to comply with the applicable laws or regulations court orders, summons, or other legal processes and lawful request from a government authority, law enforcement agency, or other similar body; or where we believe it is reasonably necessary to comply with the foregoing laws or regulations, including (as applicable) orders, requests, and other legal processes;
  • In order to enforce these terms or to defend the rights, property, or safety of ours, our affiliated businesses, or other service users, you might be forced to keep or disclose your information.

Your Responsibilities

  • I/we agree and acknowledge that use of Your Services must comply with Your Acceptable Use Policy. Content in the Services may be protected by others’ intellectual property rights. Further, I/we agree and acknowledge that will not copy, download or share any content made available to you in connection with the Services unless I/We have the right to do so.
  • I/ we agree and acknowledge that I/we shall help you to keep our information protected, safeguard our password to the Services, and keep our account information current.
  • I/We agree and acknowledge that I/We do not sue or present any demand or claim, and I/we irrevocably, unconditionally, and entirely release, waive and forever discharge FORCE TRACK, and its officers.
  • I/We agree and acknowledge that Force Track and its technical service providers are not responsible or liable for any loss, claim, liability, or damage arising out of the delivery of our information to our referrals, or any use, modification, or disclosure of our information by our referrals, whether authorized or not. Any breach of confidentiality or privacy in relation to the delivery of our information by our referrals is solely our responsibility.

Platform Access

You are solely responsible for the user content and all actions that take place on or through your Account; you are accessing the Platform on your own initiative and are responsible for compliance with all local laws/special laws and regulations applicable to you. You agree not to use the Platform or any part of it for any unauthorized purposes, including but not limited to copying, displaying, disseminating, publishing, reproducing, storing, transmitting, posting, translating, creating any derivative works, renting, or licensing the Platform; caching unauthorized hypertext; or violating any proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets of any party.

1. Account Registration

Login, sign up, account registration, and completing KYC is the process of entering into the FORCE TRACK platform. It is a process that allows I/We to create an account on Force Track, granting them access to certain features and functionalities. To register an account, I/We are required to provide accurate and complete information during the registration process. This may include personal information such as name, email address, password, and other relevant details which are asked by the platform time to time or in the process of account registration. The information can be personal or related to the business both. It is important for I/We to ensure that the information provided is accurate and kept up-to-date.

1. Type of information

  1. Personal Information: Name, Mobile number, email id, personal address whether it is a current address or permanent address, Aadhar number, PAN number, Driving License, Biometric details, Thumb impression, etc. but not limited to the above.
  2. Business or Corporate: Company Name, Company Address, Godown Address, or any Premises address, GSTN number, DIN number, CIN number, Udyog Aadhar Number, Uddyam Aadhar Number, any company certificates, Company contact details; company mobile number, landline number, mail id, website link or address or any other details not mentioned here.
  3. Bank Details: Bank account number, Bank name, branch name, Branch Address, IFSC Code, or any other details not mentioned here.
  4. Information Regarding Domestic User: User Personal details along with inquired people’s personal details.

You are solely responsible for maintaining the confidentiality of their account credentials, including their password and other login information. You should take appropriate measures to protect their account against unauthorized access. You are prohibited from sharing their account credentials with anyone else, as it may result in unauthorized access and activities on their account.

You are liable for all activities that occur under your account, whether authorized or unauthorized. Any actions taken using your account credentials will be considered as your own actions, and you may be held responsible for any consequences arising from such activities. It is essential for you to promptly notify us of any suspected or actual unauthorized access to your account or any other security breach. We reserve the right to suspend or terminate an account or take other appropriate actions, in case of any violation of your account registration terms and our Terms and Conditions.

By registering an account on our Force Track, you acknowledge and agree to comply with these account registration terms, and understand your responsibility for maintaining the confidentiality of your account credentials and ensuring the accuracy of your account information.

3. Uploading Documents & Verification

I/We agree and acknowledge that when I/We upload the documents as required by FORCE TRACK T&C on the website (Force Track) to report any employee information report (EIR), I/We is fully responsible to upload the documents and if any mistake has occurred in the process of uploading it, whether it could be technical or non – technical me/us will be totally responsible for it.

I/We agree and acknowledge that FORCE TRACK can fetch the helpers or employee proprietorship/partnership firm/company/organization director’s PAN number through the CIN number which is added by me/us on the FORCE TRACK portal at the time of employee information report (EIR) helper or employee.

I/We agree that Force Track can apply for police verification, identity verification, character verification, tenant verification on my behalf. I further agree I will provide all support and help to Force Track in this process.

Payments

  1. I/We agree and acknowledge that while making any purchases through your Platform, to provide you the accurate and complete payment information. This includes providing valid payment details, such as credit card information or other accepted payment methods, and ensuring that the payment information is up-to-date. By making a purchase, I/we authorize you or our third-party payment processor to charge our payment method for the total amount of our purchase, including any applicable taxes and fees.
  2. I/We agree and acknowledge that all payments made through your Platform are final and non-refundable, unless otherwise specified in your refund policy. Once a payment is processed, it cannot be reversed or refunded, unless there are exceptional circumstances as outlined in your refund policy. It is our responsibility to review and understand your refund policy before making any purchases through your Platform.
  3. I/We agree and acknowledge that you may use third-party payment processors to facilitate payments on your Platform, and their terms and conditions may also apply to our transactions. I/We are responsible for any actions or omissions of third-party payment processors and their services.
  4. I/We agree and acknowledge that it is our responsibility to ensure that I/We have sufficient funds or credit available in our payment method to cover the cost of our purchases, including any applicable taxes and fees. If there are any issues with our payment method or if our payment is declined, I/we may not be able to process our purchase and our access to your Platform.

1. Payment using the platform

I/We agree and acknowledge that FORCE TRACK, either directly, or through its business partners/vendors may enter into agreements with third-party payment gateway aggregators and financial institutions authorized by the RBI for processing disbursals, payments, collection, obtaining User account balance and statements, refunds, and remittance and to facilitate payment between us, FORCE TRACK, its third-party service provider and Financial Partners, as the case may be in accordance with the terms agreed by you with the Financial Partners, as the case may be.

While availing any of the payment method/s available on the Platform, FORCE TRACK will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly from any reason not directly attributable to us to you due to:

  1. Lack of authorization for any transaction/s, or
  2. Any payment issues arising out of the transaction, or
  3. Illegitimacy of the payment methods (credit/debit card frauds etc.) being used by you;
  4. Decline of transaction for any other reason(s).

Notwithstanding anything contained herein, Platform reserves the right to conduct additional verification for security or other reasons if it is not satisfied with the creditability of you/your transaction.

You hereby agree to provide accurate information, such as credit/debit information for purchasing any product or service on the Platform. You further warrant that you shall not use payment information or instrument that is not lawfully owned by you. In addition to the Terms, the terms and conditions of the Financial Partner shall also be applicable to every User. We disclaim any liability arising out of the declining of payment by such financial partners.

Upon applying for a credit facility on the Platform, you can opt to make a re-payment for the credit facility by using any of the modes of payment made available by us on the Platform, from time to time. However, it is hereby clarified that if you opt to make payments through any such mode made available by us or any third party engaged by us for this purpose then FORCE TRACK or the third party engaged by us for the same shall only act in a fiduciary capacity for such repayments.

You acknowledge and agree that FORCE TRACK is acting solely in a fiduciary capacity and shall take no responsibility as to the legality of any payment transaction between the Financial Partner and you. We do not have any obligation, responsibility or liability to verify any transactions and payment instructions authenticated and/or authorized by you.

a) Payment Modes

  • Payment through Net Banking: You can make payment for the stipulated charges for Reports and/or Products and Services through your Net Banking channel. This means that you can use your online banking facility to transfer the required amount to the designated bank account of the service provider.
  • Payment through Demand Draft: If you choose to make payment for the Products and Services through a Demand Draft (DD), you need to issue the DD in favor of ‘Business Alert Infotech Pvt Ltd.’ and make it payable at Jaipur. The DD should be sent to the Processing Address mentioned as: Business Alert Infotech Pvt Ltd., sector 3, plot no 31, Chitrakoot, Vaishali Nagar, Jaipur, Rajasthan 302021.
  • Payment through Credit Cards/Debit Cards/UPI: You also have the option to make payment for the Products and Services using your VISA, MASTERCARD, or any other credit/debit card or Phone pay, Google pay, Paytm, and other UPI modes as provided by the Payment Gateway Merchant. This means that you can use your credit or debit card or UPI to make the required payment, and the amount will be charged to your card.

It’s important to note that the specific payment modes mentioned above may be subject to terms and conditions set by the service provider or the Payment Gateway Merchant. It’s recommended to carefully review and understand the payment modes and terms before making any payment for the Reports and/or Products and Services. Additionally, it’s advisable to ensure that you provide accurate and complete payment information to avoid any issues with the payment process.

b) Payment Terms

  • Recharge the wallet: Once logged in, users usually need to recharge the wallet within the portal. In the wallet section, users may be presented with various recharge options, such as different amounts or payment methods. They can usually select the desired recharge option based on their needs.

After selecting the recharge option, users will typically be prompted to provide payment information, such as credit card details or other forms of payment accepted by the portal. They will need to enter the required information and confirm the payment. Once the payment is processed successfully, the portal will usually update the wallet balance to reflect the newly added funds. Users may receive a confirmation or receipt for the recharge transaction. With the wallet recharged, users can now use the funds to pay for services or make purchases within the portal, up to the available balance.

  • Wallet Usage: With the wallet recharged, users can use the funds to pay for services or make purchases within the portal, up to the available balance. However, the portal may have specific terms and conditions regarding how the wallet funds can be used, such as limitations on certain services, expiration dates, or restrictions on refunds or withdrawals.
  • Changes and Termination: The portal may have the right to modify, suspend, or terminate the wallet recharge service or associated terms and conditions at any time, with or without notice. Users should review the portal’s terms of service and policies periodically for any updates or changes.
  • Charges for Other Services: I/We agree to pay the charges for Products and Services as stipulated by FORCE TRACK. I understand that these charges are exclusive of delivery charges and applicable taxes & levies, and I agree to pay any additional amounts as stipulated by FORCE TRACK for delivery charges and taxes/levies.
  • Payment by Credit Card or Debit Card or UPI:
  1. I/We represent that the Credit Card or Debit Card or UPI used for payment is either my/our own card or I/we have full authority and permission to use it for payment.
  2. I/We agree and acknowledge that processing of the Request Form will occur only after FORCE TRACK receives payment in full from the Credit Card/Debit Card/UPI payment gateway merchant. If there is any error in payment, the relevant Request Form will not be processed.
  3. I/We agree and acknowledge that in case of multiple payments for the same transaction, I/we understand that I/we need to email FORCE TRACK at support@forcetrack.in or call FORCE TRACK at customer support (__________) or Direct Support: 0141- 4080800 or any other number as intimated by FORCE TRACK on its website/s (ForceTrack.in) to inform them. Upon request, I/we will provide the relevant reference number from the issuing bank or financial institution providing net banking services or issuing the Credit Card/Debit Card, in order to reverse the duplicate payment. I/We understand that such reversals will be made to the same account or Credit Card/Debit Card/ UPI from which payment was made, and FORCE TRACK will make best efforts to credit the refund after at least 10(ten)working days.

c) Payment by Demand Draft (DD)

  1. I/we agree and acknowledges that the DD should clearly state the name as mentioned above without any spelling mistakes and should be payable at Jaipur.
  2. I/we agree and acknowledges that processing of the Request Form will occur only after FORCE TRACK receives payment in full through the DD. If there is any error in the DD, the relevant Request Form will not be processed unless a fresh DD for the requisite amount is sent to FORCE TRACK at the Processing Address with all other required details. Further, I/we acknowledge and understand that the DD with errors will not be returned and will be destroyed by FORCE TRACK with intimation by email/SMS/post.
  3. I/we agree and acknowledges that FORCE TRACK will not be liable for any fraud committed on my/our net banking account or Credit Card/Debit Card/UPI, whether due to loss, theft or otherwise.
  4. I/we agree and acknowledges that the technology for enabling payment through net banking services or Credit Card/Debit Card/UPI could be affected by viruses or other malicious code. This could result in delays or failures in processing instructions. Further, I/we agree and acknowledge FORCE TRACK will not be liable, whether directly or indirectly, for any losses or damages arising from the failure or inability of the relevant bank or financial institution to honor any customer instruction for any reason.
  5. I/we agree and acknowledges that the Net Banking channel is available only if I/we have an online banking account with my/our bank or financial institution, and the said amount will be directly debited from my/our account with my/our online instructions. This facility is available only if I/we hold an account with the banks provided by the payment gateway merchant and/or FORCE TRACK, from time to time.

d) Payment by Net Banking Facilities

I/We shall use only my/our own net banking account details to transact on this Website, or I/we have full authority and permission to use the net banking account to make payment as required.

e) Referral Program

Our Force Track is excited to introduce our Referral Program, where you can share our platform with others and earn rewards! By participating in our Referral Program, you acknowledge and agree to the following terms:

  • Sharing and Earning: As a member of Force Track platform Force Track, you have the opportunity to refer others to join our platform. When your referred contacts sign up and make a qualifying purchase, you may earn, as per the terms of the Referral Program.
  • Consent and Authorization: By participating in our Referral Program, you acknowledge and consent to sharing your referral link and other relevant information with your contacts, and authorize us to contact your referrals on your behalf. You also waive any rights available to you under applicable laws, including the Telecom Commercial Communications Customer Preference Regulations, 2010, with respect to the offers or solicitations made as part of the Referral Program.
  • Liability and Responsibility: Force Track Force Track and its technical service providers are not responsible or liable for any loss, claim, liability, or damage arising out of the delivery of your information to your referrals, or any use, modification, or disclosure of your information by your referrals, whether authorized or not. Any breach of confidentiality or privacy in relation to the delivery of your information by your referrals is solely their responsibility.
  • Ownership of Intellectual Property: All rights, title, and interest, including copyrights, trademarks, and other intellectual property rights, related to Force Track Force Track and its Products and Services, are owned by us and/or our affiliates. Nothing in the Referral Program shall be construed as conferring any license or right, by implication or otherwise, under copyright, trademark, or other intellectual property rights.
  • Third-Party Links: Our Force Track may contain links to third-party websites for your convenience. We do not assume any responsibility for the content, technology, or privacy practices of such third-party sites, and your use of those sites is entirely at your own risk. You are responsible for reviewing the privacy policy and terms of use of each third-party site before registering or using them.
  • Release and Waiver: By participating in the Referral Program, you agree not to sue or make any demand or claim against our Force Track, its officers, directors, employees, agents, licensees, affiliates, successors, and assigns (collectively referred to as “Release”), and irrevocably, unconditionally, and entirely release, waive, and forever discharge the Release from any and all liabilities, claims, and demands of any kind or nature, whether known or unknown, arising out of or related to your consent and authorization for the disclosure of your information as part of the Referral Program.

Intellectual Property Rights

I/we agree and acknowledges that FORCE TRACK is the sole owner of all rights, titles, and interests in and to the Platform, including all intellectual property rights derived therefrom. FORCE TRACK offers a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to use the Platform in accordance with the Terms, subject to your compliance with these Terms. On occasion, FORCE TRACK may ask us to provide suggestions, comments, bug reports, and other feedback regarding the Platform (“Feedback”). Without requiring payment of a fee, acknowledgment, prior approval, or any other kind of limitation based on our intellectual property rights FORCE TRACK is free to use, copy, disclose, publish, display, distribute, and exploit the Feedback. Under copyright, trademark, and other laws, the Services are safeguarded. No rights, titles, or interests in the Services, in third-party content thereon, or in the trademarks, logos, or other distinctive brand elements of FORCE TRACK are granted to us by these Terms.

I/we agree and acknowledges that except as stated in these Terms, nothing in these Terms should be construed as conferring any right in or license to FORCE TRACK or any third party’s intellectual rights.

Restrictions

I/we agree and acknowledges that as a user of Force Track, I/we are required to use the platform for lawful purposes and comply with all applicable laws and regulations. This means that I/we must not engage in any activity that is harmful, offensive, illegal, or violates the rights of others while using your Platform.

  1. I/we agree and acknowledges that I/we will not be uploading or sharing content that is abusive, discriminatory, defamatory, obscene, fraudulent, or otherwise harmful. This includes any content that promotes violence, hatred, discrimination, or illegal activities.
  2. I/we agree and acknowledges that I/we will not be attempting to gain unauthorized access to your Platform or other users’ accounts. This includes any attempt to hack, crack, or otherwise bypass your security measures or access accounts that do not belong to us.
  3. I/we agree and acknowledges that I/we will not be using your Platform to distribute viruses, spam, or other malicious content. This includes sending unsolicited messages, uploading malware or other harmful software, or engaging in any activity that may harm the integrity or security of your Platform or the data of other users.
  4. I/we agree and acknowledges that I/we will not be engaging in any activity that disrupts or interferes with the operation or security of your Platform. This includes conducting denial-of-service attacks, attempting to interfere with the proper functioning of your servers or networks, or engaging in any other activity that may disrupt the availability or functionality of your Platform.
  5. I/we agree and acknowledges that I/we will not be using prohibited activities that are not exhaustive, and any other activity that is deemed harmful, offensive, illegal, or violative of others’ rights may also be prohibited. That FORCE TRACK reserve the right to take appropriate actions, including but not limited to suspending or terminating our account, removing content, or taking legal actions if I/we engage in any prohibited activity on your Platform.
  6. By using our Force Track, I/we acknowledge and agree to comply with these user conduct terms and understand that any violation of these terms may result in consequences, including the termination of our account and legal actions as applicable.

Refund Policy

  1. I/we agree and acknowledge that all purchases made through the Force Track Platform are final and non-refundable unless otherwise specified in our refund policy.
  2. I/we agree and acknowledge that in case of any technical issues or errors that occur during a purchase process, I/we may contact your customer support team for assistance.
  3. I/we agree and acknowledge that if I/we were charged in error for a purchase made through Force Track Platform, I/we must contact to customer support team within 24 hours of the purchase date to request a refund.
  4. I/we agree and acknowledges that refund requests will be reviewed on a case-by-case basis, and the platform reserve the right to refuse a refund if the company determine, in our sole discretion, that the request does not meet your refund policy criteria.
  5. I/we agree and acknowledges that refunds, if approved, will be processed to the original payment method used for the purchase. It may take 10 working days for the refund to be processed and reflected in our account.

The arbitration shall be conducted in English and shall be subject to the exclusive jurisdiction of the Courts in Jaipur, Rajasthan.

The parties explicitly concur that the laws, regulations, and rules of the country in which the parties are located will control the terms, policies, and any other agreements they sign into.

5. Miscellaneous

By signing this document, I/We grant FORCE TRACK the right to use any data and information that I/We supply via the Request Forms in any way, including for any purpose specified by FORCE TRACK, so long as doing so complies with all relevant laws.

By submitting my/our cellphone number and email address, I/We acknowledge that. I/we agree to get SMS/Email updates on the progress of my/our purchase for Reports/Products/Services placed on FORCE TRACK’s website(s) (Force Track). I/We also understand that by submitting the aforementioned cell number and email address(es), I/We have further consented to receive calls and emails from FORCE TRACK, their agents, etc. regarding any other FORCE TRACK services not specifically mentioned in this document.
